If I recall correctly, when Clarence Thomas was nominated, the president did not openly state that he was nominated because they needed a black justice to replace an outgoing black justice. Of course, "everyone knew," but in those days Affirmative Action was something to be carefully followed and documented, but never discussed in relation to individuals who benefitted from it.

For this nomination, there is no such squeamishness. She will be an Affirmative Action hire because they did not even bother to see who the best available candidate was, they just announced immediately that it would be a black female. If they had taken a few days, they might have found that the very best, and most qualified candidate (with the required liberal mindset), happened to be a black woman.

But, I don't think they would have actually wanted to do that. They want to make it clear that they are nominating a black woman for the sake of nominating a black woman. I actually think that the prog would be highly offended if Biden said, "___________ is the most qualified for the job," because that would go against the warnings from the left that we need to stop obsessing over merit.

Anyway, I assume that all but the most fanatical progs would agree that this incoming justice should recuse herself from any cases regarding AA in the future?
