Because for Trump, he was authorized to classify or declassify top secret documents under the Presidential Records Act because he was the President. He was given federal authority to have a SCIF ( Sensitive Compartmented Information Facility) built at Mar-a-Lago and keep documents there.

For Biden, the Vice President comes under the Federal Records Act where he doesn't have the authority to take classified or declassified documents with him after he leaves office, period.

Once he left the WH by 1/20/21 he was no longer the President.

And as one will recall, all the documents taken in August were not in a secure location.
They were in a storage place at MAL, where people walked in and out all the time.
And documents were found at his desk, in the drawers, in his 45 office.

Did he have the right to take any of the documents to MAL once he was not the President anymore? Or keep them and refuse to return them, after returning 15 boxes full of them without any complaints?

Let me understand this.

The 15 boxes and documents he returned by May 2021 were not HIS.

But all the documents found at MAL in August 2021 and later at the storage unit WERE his.
