Neither is correct. The first commission of any such offense, is to be fined under title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under title 18, or imprisoned not more than 2 years, or both.

The fact is very few people who are caught crossing the border illegally ever spend time in prisons for several reasons.

Since this is a criminal conviction instead a deportation, the rules are bit different. There has to be evidence that person actually crossed the border. Being in US undocumented is not enough.
Secondly, it just doesn't make sense to hold a criminal trial because even if found guilty it will only delay deportation while the defendant enjoys up to 6 mos or up to 2 years free room and board at government expense. In prison, they often learn the methods they can use at their deportation hearing to stay in the country legally.
