If Garcia's protection order (withholding of removal status) was lifted, which appellate court resented the order.

Garcia and family had moved twice to get out of MS-13 territory in El Salvador where they were constantly under treats from MS-13 for not paying tributes and rents. It seems pretty far fetched that Garcia would seek membership in this gang. He and his family spend years trying escape from MS-13 and Barrio 18.

Bottom line is we sent someone who has never been convicted of a crime in US or anywhere who was under a protection order by a federal judge to one of harshest prisons in the world for life based on double here say evidence and a tattoo that could indicate gang membership.
