Then apply the law. While I support state's rights, I disagree with how some states apply their laws. Giving the death penalty to a parent whose child committed murder shouldn't be automatic. If the parent exercised due diligence yet the child stole the weapon anyway, I think that should be litigated in court, not with a rope on the gallows next to the kid.
