Says who?Did you bother to notice the uniformed officers and the plain clothes officer? None of them look even remotely threatened. Plus there was a Tac Team right in the stairwell. The only person who seems to have felt threatened was Michael Byrd who fired without even trying to block access. You might notice that one of the uniformed officers was right next to Babbitt and Byrd‘s shot missed him by less than a foot. That was anything but a good shooting. The wall behind Babbitt was stone, there was a good chance a through and through round would ricochet unpredictably endangering the other officers and members of the crowd.

That constitutes a lethal threat which justifies the shooting. 140 or so police officers were injured and one died from these unarmed protestors. Show the tape of the mob attacking police officers and have a dew testify about how they were attacked and the physical suffering they have undergone since they were attacked. These thugs had no business being there nor any legal right to be there.
Was it justified to shoot her? No. Is there any way to win that argument when she was breaking into the Capital Building? No.
