Babbitt $30 million settlement


In the latest indication that the Trump Department of Justice wants a truce in former President Joe Biden’s war on those involved in the Jan. 6, 2021, Capitol riot, federal lawyers for the first time have signaled support for settlement talks in the Ashli Babbitt wrongful death suit.

After months of fighting the suit brought by the husband of the retired Air Force veteran shot dead by a United States Capitol Police officer as she entered the Speaker’s Lobby off the House floor, Justice changed its tune last month, according to a new court filing.

“The parties have agreed to work in good faith to narrow or resolve issues in this case,” said the latest filing agreed to by Justice lawyers and Washington-based Judicial Watch, which is handling the suit for Babbitt’s estate and her husband, Aaron Babbitt.

The wording is the first to suggest settlement negotiations are underway in the $30 million lawsuit filed by Judicial Watch last January.

Officer Byrd used excessive force.
He did not give any warning before he shot Babbitt.
He could have tasered her or just simply pushed her back.
Byrd should be brought up on federal charges of violating Babbitt's 4th Amendment civil rights.

There is nothing in either the spirit or letter of the first amendment that gives you the right to assault people, break and enter property that is not yours, vandalize property or assault police.

I am shocked you're okay with the murder of an unarmed woman. Law enforcement can only use lethal force if directly confronted with lethal force. If anyone can explain to me how an unarmed woman presented a lethal force threat to Byrd I would love to hear it. Otherwise, it is murder, plain and simple.

That isn’t actually true and different jurisdictions have their own sets of policies and guidelines regarding use of force.


For example, the DoJ:
Law enforcement and correctional officers of the Department of Justice may use deadly force only when necessary, that is, when the officer has a reasonable belief that the subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person.

A post-Jan 6 investigation found that the Capital Police don’t have very clear “use of force” guidelines and many of the police felt hindered from using enough force out of fear of reprimand.


Capitol Police officials told the GAO in October 2021 that the department neither encourages nor discourages officers from using force, but instead trains them to use the appropriate level of force necessary and to aim to de-escalate situations so force is not needed. Further, the Capitol Police officials said disciplinary action by the department related to officer use of force has historically been extremely rare.

The Capitol Police use of force policy in place leading into the Jan. 6 attack said that “officers are only authorized to use the level of force that appears reasonably necessary to bring a subject under control while protecting the lives of officers and others.”

Further, it said officers are expected to “evaluate and respond to situations based on the totality of circumstances that can include the number of people the officer must contend with; the size, age, and condition of both the officer and suspect; the presence of bystanders; and the availability of weapons.”


If anyone can explain to me how an unarmed woman presented a lethal force threat to Byrd I would love to hear it. Otherwise, it is murder, plain and simple.

As this was happening no one knew whether or not she was armed, in addition she had a backpack with unknown contents.

She and a violent mob that was WITH her, that she was PART of, were breaking down the door behind which the police were protecting the remaining people still trapped in the room.

I suspect if she were a brawny dude with an Antifa sticker on his face we wouldn’t be having this conversation.

Byrd panicked and fired into a crowd and murdered an unarmed woman. Others were closer to Byrd and potentially more of a "threat."

By the way, Ashli Babbitt was shot in her back left shoulder blade. So, the Dim hero Byrd, shot an unarmed woman in the back. She must have been really scary.
