Well, first, Indians at that time had their own Treaty Nations with the US.

Secondly, an invader is part of an organized army, not disorganized people from multiple nations, often trying to get away from their own government.

Third, the Author should have written down explicitly that "illegals" were excluded. The problem was at the time, there was no such thing as an "illegal". You got here, you were golden.

To prove the point, what if 250 years from now the US became the most populous country in the world who could barely feed its people. We didn't start trying to restrict immigration until non-white people started showing up. (And by that, I mean even Italians weren't considered "White enough".)
