A president has a very broad authority to de-classify information. He is not required to consult anyone. He is not required to get anyone’s authorization. Nor is he required to tell anyone he did it.

His lawyers informed him of the issue and agreed to ultimately return them to the NA.

If he didn't know they were, that would be an even bigger problem, because it exposes a gaping hole in our security. If he didn't know they were there, WHO packed them up by WHOSE authority, and WHO didn't bother to find out where they went? Did people without the proper clearance handle them in the packing up process? It sounds an awful lot like everyone is saying, "As long as we can protect Quid Pro's from this, there's no problem". Ultimately, though, Quid Pro is responsible, because they were in HIS office and they were found in HIS garage. Somebody at that level needs to make sure they are not taking classified documents when they leave office. If he literally didn't know that somebody put them in with all of his other stuff, he's incompetent, because he should have been in his office at least the day before he left, going through everything and getting the classified stuff back where it belongs.

It’s actually not unprecedented for classified documents to be found in random, secure places even before Trump. I will concede, however, that there is no defending those documents being at his house. Biden definitely ate his words when he criticized Trump for all this. You also make a fair point about who else might have seen them. Of course I question what you criticized Trump about as far as this goes.

However, there are still big differences between Trump and Biden.

1) Trump knowingly kept those documents and refused any attempt by the NA to return them. Biden returned his once they were found. The NA never went looking for those documents beforehand either.

2) Trump is also accused of destroying some of these documents.

Why is it not a legal problem?

He illegally possessed these documents for more than six years. There’s no statute of limitations as the crime was a six year plus continual criminal act.

It is certainly both a legal and political problem.
