Nope. He either claims Doctor / Patient privilege or pleads the Fifth. Two completely different issues. He could have, but didn't invoke HIPAA, because it doesn't apply in testimony to Congress.

"Again, President Biden's White House physician pled the fifth. This is unprecedented, and I think that this adds more fuel to the fire that there was a cover-up."

 
I believe there are people who want to make an example out of him and that's a good reason to plead the 5th.

Some of the questions he refused to answer had nothing to do with Biden’s medical records. At least one was something on the order of “did you ever notice symptoms of lack of mental acuity”. Or it might have been “did you notify anyone of Biden’s lack of mental acuity”. I only heard the question once and wasn’t paying a lot of attention to the wording.

The thing is, can you plead the 5th on part but not all of your testimony?
  • Did you ever notice symptoms of lack of mental acuity?
    • YES. Then why didn't you report it? Culpability.
    • NO. Medical incompetence. Culpability.

  • Did you notify anyone of Biden’s lack of mental acuity?
    • YES. Who did you report to?
    • NO. Medical culpability.
There is no good way for the doctor to answer these questions, as, bottom line, Biden was off in LaLa Land and no one ever did, said, or reported a single thing.

You can’t arbitrarily take the 5th, if Congress grants him immunity for his testimony then he can’t take the 5th and would have to answer, because his testimony would no longer be prosecuted.

They used this on the mob in the 70’s.

Clearly he has a good reason to plead the 5th. I guess that answers that question.

Congress can offer immunity, but they can't force him to accept immunity.
