The one who killed a guard was allowed to have a hammer to fix something in his cell. that's not very good prisoner management.

Depends on the situation of his case. This guys sounds like a mentally ill prisoner who wasn't properly controlled.

If the guys is truly mentally ill, then, no, he isn't responsible as a matter of American law.

It highlights the craziness of having the Presidential Pardon. I have no idea who these people are. But were they any less guilty on 12/23/2023 or 12/23/2022???? Nope. Why didn't he pardon them then? Clearly the answer was that it is a political calculation. Keep in mind he didn't overturn their convictions or set them free (the way Trump is going to) but they lived under the threat of lethal injection for years for no reason.

A prisoner could kill someone with a stone, a ballpoint pen, a belt or piece of string, or his bare hands.
 
If a prisoner is truly insane and incapable of knowing what he's doing (very few are in this category), that would make him all the more dangerous, and liable to kill more people, no ?
