I agree. But when a suspect if running away, they are not an eminent threat.

They are when they fire a weapon at you while running away

The People could argue in court that the suspect had demonstrated that he was willing to shoot a cop, and that the cops did not know whether or not the suspect had a second unfired weapon that he might be willing to use, but I doubt if the jury would have bought that as justifiable homocide, in view of the fact that the tazer was no longer loaded at the time he was killed.
