The argument isn't against the autopen in isolation; it's against the autopen being used without direction from the president.
The constitutional argument is: if the president didn't sign it, and the president didn't direct/approve something to be signed with his signature, then it wasn't an action taken by the president.
I doubt if too many of the former vile dem operatives in the Biden WH are gonna want to fall on their swords for the old fart when they are made to testify under oath in the investigations that will be sure to follow.
