The AEA is very specifically worded.

It says "declared war".

It also says "or any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government"

I think they've made a good argument that these gangs are here at least with the blessing of Maduro, if not at his explicit direction.
I would prefer if President Trump invoked a different authority. He has plenty of them, at least half a dozen.

That being said, I agree we're figuratively "at war" with foreign gangs.

The thing is, in reality they're more domestic than they are foreign.

I don't think it's a great idea for the president to stretch the law in such an obvious manner. Even though I support what he's doing.

Nope. Just not planning to let it slowly be put in place with the frog-in-the-pot, slow heat slow boil implementation. This use of the act is not what prompted it's creation, nor it's intent. I'll take due process, thank you very much.

If they were enemy invaders, they could be shot at the border, defending our sovereignty. It kind of depends on how you define enemy. Does that count students on student visas attending college, that took a large protest by teachers, fellow students, and community leaders to get a hearing and release, while on the list to be fast track deported? How about born and raised in Florida, complete with birth certificate arrested, even though his background could be known from his Florida Driver license? How about Native American Navajo, living off the reservation, that just happened to look Hispanic, so were gathered up? How about an American Citizen and veteran in New Jersey that was picked up? How about the Puerto Rican, seafood warehouse manager in New York, even though Puerto Rico is a US Territory?

So, if specific Americans are not willing to house and feed lawyers, nobody is entitled to due process protection under the law and the constitution?
Why is that not what the conservative Supreme Court ruled? Or do you guys no longer recognize the Supreme Court as the supreme interpretation of law and the Constitution?

Well, A). The very act of sneaking into the country undocumented is a crime, a felony, so the innocence of the person has already been ruled out, so, a hearing over what?

And B). For your home country to lock you in prison, I would think charges or a conviction would already have to be in effect, either that or soon after incarceration. Sounds to me like Abrego Garcia needs to find an attorney.

Misdemeanors don't get you sent to prison in civilized countries, and being a border jumping wetback is not a felony. I have not even seen it proposed in Congress to make it a felony. Quite honestly, though, I would not mind seeing it legally made a felony. It surprised me, that is was not. Proving it, would be a snap, and I do not give a sh#t what happens to felons, foreign or domestic, as long as they get a trial or hearing to prove they are innocent, if they in fact are.
