The trial is tomorrow.The judge dismissed 8 of 10. And was crystal clear that Kari has an enormous burden of proof to establish:
“Evidence is not before the Court at the motion to dismiss stage – pleadings, made under the auspices of Rule 11 (the rule governing sanctions) are,” the judge wrote. “Accordingly, Plaintiff must show at trial that the BOD printer malfunctions were intentional, and directed to affect the results of the election, and that such actions did actually affect the outcome.”
She has presented nothing that the malfunctions were intentional. She can't find a single person who couldn't vote because of the malfunctions. And she has shown nothing that the election's outcome was affected.
And lets be clear, the judge's statements did not bode well for Kari. He made it very clear that sanctions were on the table if she couldn't back her claims with evidence.
