Garland Moves to Release Details on Search of Trump’s Home



So you've all been demanding the release of the warrant, eh?

Be careful what you ask for. Garland has called your bluff.

Now that the AG has asked the judge to allow him to release the warrant to the public, along with an inventory of what was seized at Trump's hideout, Trump has until 3 pm tomorrow to put the kibosh on the request.

Will he? What excuse will he give?

Mr. Garland said he had personally approved the search after the failure of “less intrusive” attempts to retrieve material taken from the White House by Mr. Trump.
Mr. Garland provided no details. But the person briefed on the matter said investigators had been concerned about material from what the government calls “special access programs,” a designation even more classified than “top secret” that is typically reserved for extremely sensitive operations carried out by the United States abroad or for closely held technologies and capabilities.

Government officials have expressed concern that allowing highly classified materials to remain at Mr. Trump’s home could leave them vulnerable to efforts by foreign adversaries to acquire them, according to another person familiar with the Justice Department’s thinking.

Trump cannot just wave a magic wand to declassify.
There is a process that he failed to follow.

No there isn't. The Constitution gives full authority to the President, Vice President, or any person they allocate that responsibility to in his administration. It's like saying the President can order Congress to write bills no more than 40 pages long. A President can't do that. The Constitution gives the power of spending and making laws to the Congress.

The Congress, the judges, the defense department cannot regulate how a President can use his constitutional powers. That's up to the President.
 
We have no idea what they found or how sensitive they are. Do you really trust the MSM who (like the FBI) are in bed with the Democrat party?

If you don't like the idea of the President having all that authority, then tell the Democrats offer a constitutional amendment. A President not only has the authority to declassify, but classify as well. Let's see how many of these documents get re-classifed by Dementia. I'm willing to bet not a one of them.
No, but I do trust the redacted affidavit the DOJ filed with the court and the result of the search warrant filed with the court. You should read the documents before commenting. The links are listed below. The following is information included in the affidavit and the receipt from the search in regard to classified documents.

47: From May 16-18, 2022, FBI agents conducted a prelimina1y review of the FIFTEEN BOXES provided to NARA and identified documents with classification markings in fourteen of the FIFTEEN BOXES. A prelin1ina1y triage of the documents with classification markings revealed the following approximate numbers: 184 unique documents bearing classification markings, including 67 documents marked as CONFIDENTIAL, 92 documents marked as SECRET, and 25 documents marked as TOP SECRET. Fm1her, the FBI agents observed markings reflecting the following compa11ments/dissemination controls: HCS, FISA, ORCON, NOFORN, and SI. Based on my training and experience, I know that documents classified at these levels typically contain NDI. Several of the documents also contained what appears to be FPOTUS 's (Trump) handwritten notes.

Note: that the above classified documents did not come the search warrant of Mar A Lago but from the 15 boxes sent by Trump to the NARA in January 2022 which is the 48th item listed as causes for the search. The dissemination controls indicated CIA human asset material and not be released to any foreign national.

The Search Warrant receipt listed the additional boxes containing classified documents found.

Except for the fact that Trump's declassification policy was that anything that leaves the oval office is automatically declassified. This is no different than the phony Russian collusion, fake impeachment, and the Kavanaugh rape thing. When are you going to learn not to trust anything the MSM tells you about Trump? The last paragraph is true. However, the first paragraph is not. You will not find this power listed in the constitution. The president's power to classify and control access comes from a Supreme Court ruling in 1988, Department of the Navy v. Egan, 484 U.S. 518 (1988). Various experts have interpreted the ruling to mean the president has unlimited powers in regard to classification. That has not been tested in court and if Trump tries to use it in a defense, it would certainly end up in the Supreme Court. This is one of the reasons the DOJ has bypassed the classification issue by listing statues in the search warrant that do not mention classification thus making it irrelevant.

If Trump were to use declassification in his defense it would put him in a very award political situation because declassifying the most secret documents would make him responsible for disclosing some of the most sensitive information to our enemies in order to escape prosecution. In fact, he should have never said that he classified the documents he was taking with him because it indicates that he intended to take them so he can not claim that they were taken by accident.

First off the problem is this unconstitutional warrant. The Constitution says searches must be conducted by authorities with a warrant that specifies things to be searched and items to be taken. This is a general search warrant that basically says search where you want, and bring back whatever you find against Trump. Secondly, this judge did not recuse himself like he did in a previous Trump matter. His hatred of Trump is well documented in his Facebook posts and he's going to have to answer why he even considered the case.

You can declassify without making it public. How in the world would declassification make these documents available to our enemies?

The majority ruling in the 1988 Supreme Court case Department of Navy v. Egan — which involved the legal recourse of a Navy employee who had been denied a security clearance — addresses this line of authority.

"The president, after all, is the ‘Commander in Chief of the Army and Navy of the United States’" according to Article II of the Constitution, the court’s majority wrote. "His authority to classify and control access to information bearing on national security ... flows primarily from this constitutional investment of power in the president, and exists quite apart from any explicit congressional grant."

Steven Aftergood, director of the Federation of American Scientists Project on Government Secrecy, told PolitiFact in 2017 that such authority gives the president the authority to "classify and declassify at will."

Trump loves this country more than the last five Presidents before him combined. Furthermore again, anything that leaves the oval office is automatically declassified. When Trump left the White House he was still our President.

You do realize that if the president declassified those 183 documents, he would be declassifying not just the copies he removed but all copies which would make the documents available to the public.

Some of the 25 top secret documents were classified top secret/sci, the most secret of all documents. This classification is reserved for document containing information such as ongoing covert operations, assets in high levels of foreign governments, electronic intercept codes, details on nuclear deployment, etc. I have always suspected Trump was a bit of a coward but I would never expect him to make public information that would cause grave damage to the national defense to save his ass from possible criminal charges.

Why wouldn't you think he would do that very thing? Seriously why? In the 40 some odd years he has put himself in front of cameras what would make you think anything would be out of reach for this creature to do?

So what we have is clear violations of the US Constitution and law. The warrant never said a damn thing about confiscating attorney/client documents. The IRS (acting on behalf of the government) ordered the silence of free speech. The only good thing about this is the raid will cause more people to vote Republican in November, and once again, the Trump haters are going limp.
