You don't need troops or airforce to attempt to prevent Congress from certifying an election. In terms of seditious conspiracy, you only have to conspire to do it. Doesn't matter if you don't follow through with your plans. Doesn't matter if you don't have the ability to follow through. Just planning it with others is the crime. That's not something Epps was caught doing.

Just going into the Capitol peacefully doesn't stop Congress from counting the votes. If I recall, Epps said he thought it was legal to enter the Capitol when he first said it.
