After several times telling Juanita to get her belongings and leave, she refused officers’ commands and stated, ‘Unless you carry me out of here, I’m not going anywhere,’” the report said.

Fitzgerald was warned that she would be arrested if she did not leave, but continued to refuse to move.

“Juanita still did not listen and refused to leave, stating again to ‘carry me out of here,’” the report said.

The 5-foot-tall, 100 pound woman purposefully slid onto the floor as officers tried to escort her from the building and allegedly resisted officers’ attempts to lift her up, investigators said.

Fitzgerald was eventually escorted to an officer’s patrol vehicle and taken to the Lake County Jail.

The officer noted that due to her age and possibility of injury, Fitzgerald was not handcuffed.

The Eustis police report said that Franklin House staff offiered to help her move, but refused.

She also refused assistance from the Department of Children and Families, The Homeless Coalition, Department of Elder Affairs and eight other agencies, officers said.

Fitzgerald was being held at the Lake County Jail in lieu of a $500 bond on a charge of trespassing.

I think the article also said she was not cuffed???? Some conflicting information there. And also she refused several other options offered her? I would think it more humane to take her to jail than to dump her on the street. And even a 93-year-old cannot willfully refuse to pay rent or follow the rules of any facility.

I know my 91-year-old aunt who, with my permission, makes me and my husband her first line of defense/rescue in all matters is quite mentally and physically capable of knowing what is right and wrong in a situation. She is fully mentally capable to know that she must follow rules required for her and everybody else's safety and that she has to pay her bills or face the same consequences as anybody else.

So I don't know what the whole story is there and can't make an informed opinion as to who is in the wrong.

And she is out of jail. Sad it got to that. I think the police didn’t know what to do at that point. Too bad the courts didn’t appoint an ad litem.
 
Seems they cuffed her when getting her to the car as she kept squirming out of her chair to the floor, but once in the vehicle, took the cuffs off. She was cuffed when interviewed by the press. They stated is was standard protocol.
Sounds like she wasn’t willing to receive any help, even other tenants offered her help, but she refused that as well. She just wanted to stay there, no matter what. I worry if she was having money troubles, but too proud to ask for help, even when offered help or maybe even scammed. If not, dementia is probably setting in.

What ever the reason just a sad story all around. Too bad her family didn’t just show up to help when they were contacted.

When I was little my grammy was cooking beans and she kept saying they wouldn't cook. It went on for hours. Finally they checked and she was cooking our marbles.

And she is out of jail. Sad it got to that. I think the police didn’t know what to do at that point. Too bad the courts didn’t appoint an ad litem.

When we lived in another state, I was part of an effort to organize and raise funding for a domestic violence facility in our area as no program for that existed at that time. Until we could raise sufficient funding to build and staff a safe house for domestic violence victims, we would place them in homes of our group until we could arrange for something more permanent for them. We worked closely with law enforcement in that as it definitely put us and our families at risk should a violent person find out where his wife and/or kids were placed. And because the victims were not always reliable to keep their whereabouts confidential, we maintained a hard and fast rule that only one family would be placed in any private home at any given time. This at the recommendation of the police.

The Salvation Army would take as many as they could, but they were limited by law as to how many people could reside at their facility at any given time and they often were full of the homeless or others who for whatever reason needed shelter.

So if there was no safe house or other facility to place a woman and/or kids, the police sometimes housed them over night at the jail rather than put them out on the street.

In this day and age, I can just imagine the snowflakes and cop haters would headline it: "Woman and kids, victim of domestic violence, jailed."
