Nov 3 (Reuters) - A U.S. appeals court on Friday upheld an Illinois state ban on assault-style weapons and high-capacity ammunition magazines enacted after a 2022 mass shooting in Chicago's Highland Park suburb that left seven people dead and dozens more wounded.

In a 2-1 vote, a three-judge panel of the 7th U.S. Circuit Court of Appeals threw out a lower-court injunction imposed against the firearms restrictions in one set of cases and affirmed decisions keeping the law intact in another batch.
No one expected the 7th to overturn the ban - the real question is what rationale it would use to uphold it
To describe the ruling/opinion as laughable would be far too kind...

The State of Illinois, in the legislation that lies at the
heart of these cases, has decided to regulate assault weapons
and high-capacity magazines—a decision that is valid only if
the regulated weapons lie on the military side of that line and

thus are not within the class of Arms protected by the Second
Amendment.


In other words, "all bearable arms" does not apply to firearms used by the military.

How is his consistent with Heller Caetano and Bruen ?
Can anyone here specify a class of arms NOT used by the military?
Can anyone tell us what military uses the AR15?

What do you think the USSC will say about this?

The ruling addresses solely the preliminary injunction, not the constitutionality of AWBs.

The leftists on these courts are hoping to wait out the next election. If the democrats win, then a democrat President will likely replace Thomas and/or Alito, giving them control over the Supreme Court, just at the time these cases will hit the Supreme Court, allowing to rule them Constituitonal....

This is why it is so important to vote out the democrats, especially in the Senate and the White House.
 
Yep, the Supreme Court will see this case and decision and it will not bode well for these liberal judges.

Unless the democrats win in 2024........if they do, they will replace Thomas and Alito, and make this ruling Constitutional.

Judges can't just be "replaced", unless you're suggesting some type of collusion to have them removed or force resignation.

They are both in their 70s, and could die or retire in the next Presidential Term. If the democrats win the White House and the Senate, really they only need the White HOuse, they could replace one or both of them. The Supreme Court would then be over as an actual judicial body, and Constitutional branch of our government, and will simply become a rubber stamp for the democrats.
