Ok, let’s say that everything is the way you say it is. How many corporate executives in the State of New York have gotten anything more than a fine for that?

Falsifying business records in NY is just a misdemeanor and subject to a fine.

Falsifying business records to coverup a crime, however, is a felony which can include a prison sentence.

  • How many corporate executives in New York were running a Presidential Campaigns?
  • How many of that group boinked a porn star while their wife was at home having just given birth to his son?
  • Then how many of that group had a fixer lawyer break the law to pay the porn star not to revive previously published media stories (6 year old?) about the boinking?
  • Then how many of that group had their lawyer commit criminal campaign finance law violation and went to prison?
  • Then how many of that group committed felony business record falsification to hide and aid in the crime that the fixer lawyer engaged in?
By the time you start at the top bullet and keep narrowing it down to the last bullet, I'd say it's either (a) a unique situation for the relevant events, or (b) not many.

(Although Daniels wasn't an extortionist. She didn't go to Trump and demand money. She was shopping the story to media and the campaign came to her.)

She didn't threaten anyone.

She was shopping the story to media outlets, as story that had already been published years before. The campaign found out about it and (along with the McDougal story) send out Cohen to "Fix" the problem to "catch and kill".

Funny thing is, there is nothing illegal with "catch and kill" (i.e. paying for an NDA). What caused the legal problems is not filing the expense with the campaign as an "in kind" contribution and committing felony business record falsification to hide/aid in the process. Since it was just days before the election, the filing of the paperwork wouldn't even have occurred before the election so would still have been hidden from the public till after the election.
