"We" are now embarking on the ungodly expensive, totally pointless, utterly ridiculous process of pretending to justify an execution that will NEVER, under any circumstances take place. This is truly American criminal jurisprudence at its worst (excepting of course criminal misconduct by officers of the court).

Tsarnaev will be convicted after months of pointless machinations, and the jury may even say "yes" to execution, but in the Peoples' Republic of Massachusetts, the execution will never, ever happen.

Prosecutors could have negotiated a plea bargain many months ago, which would have spared the Commonwealth and the Nation's journalists and readers millions of hours of pointless handwringing, but instead we will have this charade, which does nothing more than showcase to America and the World that our criminal justice system can be manipulated to the point of absurdity, and we are powerless to stop it from happening.

Its a simple disconnect between the rulers and the ruled. The rulers think the DP is pointless, but the people still see it as viable for certain crimes.

Tsarnaev is being charged under federal death penalty charges in Massachusetts, and no potential juror who objects to the death penalty will be seated.

You shouldn't alter our legal process because we're all outraged

Sure he did it, and he'll pay.
 
The point is that an impotent death penalty is worse than no death penalty at all.

Assume the jurors vote to execute him. Then we have years of appeals and years of delays and the Executive not finding time to sign the death warrant, and on and on.

If we just lock the bastard up and throw away the key, he will be forgotten in no time. If he is sentenced to death, his case will be brought up again and again for decades.

There's also the problem of Dzhokhar Tsarnaev's arrest since authorities used a public safety exception to delay reading him his Miranda rights. If he made any "confession" before being informed of his rights, Tsarnaev may have grounds for numerous appeals.
