Your evaluation that Apple lost it ass is just a speculative opinion because you do not know how much Apple made from using the patent and what the final figure actually means to Apples gain or loss.

The courts crunch the numbers and determine what Apple owes. It doesn't matter if Apple had a net gain - they had other technologies in the phone that they deserved to make money. They are only responsible for the infringement of the specific technologies that were incorporated into their devices.

Yeah...when you enter the market with your idea. If you're the only one in the world with the "USMB Widget", you have no competition out of the box. At some point, seeing your success, someone is going to want a slice of that pie. But a patent protects you from them just stealing your idea to get a slice. They will have to do their own R&D, come up with their own ideas, etc.
