The government throws a man in jail for mocking a girl

As usual, there's far more to the story than FOX tells:

Ohio man ordered to jail after mocking 10-year-old neighbor girl with cerebral palsy - NY Daily News

The menacing charge is related to an incident in which the girl's mother claims Bailey threatened to choke the mother with a chain, the newspaper said.

Stark County Sheriff’s deputies had been to both families’ homes to investigate, and have also responded to other name-calling and loud music complaints, according to The Repository.

“This didn’t stop him,” Michael Knight told The Repository. “We do live next to him and it’s ongoing.”
Bailey declined to comment after the hearing.

The story also said that one of the problems between the families is the Knight's reactions to and comments towards Bailey's son's ADHD, which, ironically enough, is not the "recognized" or socially sympathetic disability cerebral palsy is.

Maybe there needs to be a bit more understanding from both families, but that really doesn't account for FOX trying to lay the court's verdict or the man's plea solely at the feet of his mocking behavior without mentioning the menacing he engaged in.

so can we be arrested for "menacing" on a discussion board?

In theory, if there were a raging flamefest directed at someone it's possible, however in that particular case the "victim" would have to prove that he/she was singled out and that flaming isn't a regular thing here.

As for the little girl, she should certainly be able to go to public places without being bullied. However, her mom might want to avoid taking her to a place that might be named Very Mean People That Flame the Hell Out of Everyone Different Than They Are Bar & Grill.

sounds like both families need to be taught a leson

Canton Municipal Judge John A. Poulos ordered the maximum sentence for 43-year-old William Bailey, who pleaded no contest Tuesday to reduced misdemeanor charges of disorderly conduct and aggravated menacing.

The (Canton) Repository reports that Bailey was caught on cellphone video at a school bus stop in October making fun of how the 10-year-old disabled girl walks.

The video of him seemingly imitating her limp was disseminated online and on local TV news. Bailey denied he was mocking the girl, saying he was reacting to name-calling directed at his 9-year-old son.

The video was shot in October by Hope Holocomb's grandmother at a bus stop, and shows what appears to be both Bailey and his son each walking with a pronounced limp.

Bailey, for his part, declined to talk on camera, but at the time told The New York Daily News that he was injured on the job and was suffering from bruised ribs and twisted back when the video was shot.

His wife told Fox8.com that this is all part of an ongoing dispute and that Hope's family has called her son names.

So, a 43 year old ADULT parent of a 9 y/o boy, who (Mom claims) had been called names:
*what names
*what context
*who called the 9 y/o names

mocks a 10 y/o disabled girl and includes his son along for the adventure.

The children can't settle the dispute themselves?
Seriously, at that age both children probably would have grown out of this stage had not the parent involved himself.

WTH is wrong with this country??

Ya might want to check the fox story again, it mentions both charges.

So ridiculing a disabled girl is your idea of free speech??

So you don't know the difference either???

Judge Sentences Ohio Man to 29 Days in Jail for Imitating Disabled Girl's Limp
November 28, 2012 - In an apparent case of rudeness being elevated to criminality, a 43-year-old Ohio man has been sentenced to 29 days in jail for mocking a ten-year-old girl with cerebral palsy.
Canton (Ohio) Municipal Judge John A. Poulos ordered the maximum sentence for William Bailey, who pleaded no contest Tuesday to reduced misdemeanor charges of disorderly conduct and aggravated menacing, the Associated Press reported. According to the The (Canton) Repository, Bailey was captured on a cellphone video imitating the way the girl, who uses crutches and has trouble walking.

An earlier report in The Repository said Bailey and his nine-year-old son walked away from the bus stop, dragging one leg. They were videotaped by the girl's mother, Tricia Knight, who took the video to local television stations, where it was played on-air. William Bailey reportedly said he was reacting to name-calling and taunts directed at his son by the Knight family.

Municipal Court Judge John A. Poulos on Tuesday ordered Bailey to report to the Stark County Jail on Jan. 2 to begin a 29-day sentence. The Repository said he must also pay $400 in court costs plus fines. Bailey apologized to the girl and her family in court. Jennifer Fitzsimmons, Canton’s assistant city prosecutor, was quoted as saying, "It's unfortunate that it had to come to this,” but she also said the case would bring "recognition to the problem" of bullying.

MORE & Video
It IS free speech, and we all know the difference.

Do you really think this assholes behavior rises to a jail sentence?

Wow.

No, it shouldn't be criminal. The guy is a first class creep, but being an rude idiot isn't illegal. The guy hurt the girl's feelings and he owes an apology, but no legal action should be taken.

People get hurt feelings every day, even worse than this. Are guys who cheat on their wives/girlfriends and really hurt them going to be arrested now? That kind of hurt is worse than being mocked.

What about people who get caught talking about other people behind their backs? Should they go to jail for hurting their friend's feelings?

Maybe those who ridiculed Sarah Palin and her youngest child should be arrested. There were some pretty raw comments made about Trigg.

Obama insulted the participants in the Special Olympics when he was on the Tonight Show.

What did this idiot do that is worse than any other example? The lesson for the girl is that there are stupid people in this world and you can't take them seriously.

It mentions both charges, but not the reason for the menacing charge, making it seem as if the harassment / mocking was the reason for that as well.

I agree, but it was Bailey who made a threat.

I didn't see anything in either story that would justify the aggravated menacing charge, there was nothing that said he approached the girl or made her fearful.

Barb, my take on the issue...

1) ADHD is treatable in children using medication; many times the child will learn coping methods and can grow out of it.

Attention deficit hyperactivity disorder - PubMed Health

2) Cerebral Palsy: There is no cure for cerebral palsy.

Cerebral palsy is a group of disorders that can involve brain and nervous system functions, such as movement, learning, hearing, seeing, and thinking.

There are several different types of cerebral palsy, including spastic, dyskinetic, ataxic, hypotonic, and mixed.

Cerebral palsy - MayoClinic.com

There is no comparing the two.

Maybe it was the age difference; a 43 y/o male adult vs a 10y/o female?

MeBelle, the point was that the family with the child suffering socially sympathetic and "recognized" challenges was picking on the kid with (I mean, look at your response) a challenge that is NEITHER, all the while being aghast that the same was done to theirs in (supposed) retaliation. The irony being that if ANYone should know better, lead by example...they should.

You think the kids care one way or the other, or evaluate their conditions the same way adults do (or should?)

Avatar, a 43 y/o male vs a 10 y/o female is beyond bullying and probably threatening for the child.

I know you don't agree with this type of behavior.

Ahhh, caught me before my edit...I see how you are ;)

On a personal note; both conditions have affected close family members.

On a professional note; working with children afflicted with these medical conditions, I can understand why a parent would threaten the ADHD child with a chain hold around his neck.
The child afflicted with CP to the point where she is using crutches poses no harm to the child afflicted with ADHD.
Again, on a professional note, both children are attending the same school and part of their education is learning tolerance toward each other.

Now the parents, on the other hand, should be court ordered to be educated in order to understand the other child's affliction.

My son had, or so the school said, ADHD. I would never threaten him with any such thing, nor would I medicate him. He got a cup of coffee every morning and plenty of fresh air and exercise.

The parents should be horse whipped.

Let me preface this by saying that that man was being a total ass wipe. But I don't want the government thinking it's their right to throw people in jail for exercising their first amendment rights. That's every bit as despicable as what that ass wipe did.

What do you mean by government? I believe this is a local matter, not a federal government matter, don't use such ad hominem arguments against the federal government.

The video was shot in October by Hope Holocomb's grandmother at a bus stop, and shows what appears to be both Bailey and his son each walking with a pronounced limp.

So not only was this man mocking a cripple child SIMPLY for the thrill of hurting a child's feelings, this cretin was TEACHING HIS SON how to hurt a cripple child's feelings, too?

The charge against him OUGHT TO BE for what he was actually doing to his son: CORRUPTING THE MORALS OF A CHILD.

Not only should he go to prison, but his children should be taken away from him and given therapy to counteract the value system he was obviously taught them.

This article really has NOTHING TO DO WITH FREE SPEECH, kiddies.

This man is a sociopthic or more likely psychopathic personality who is obviously a menace to society.

Lock him up and throw away the key.

If he thought he could get away with this kind of pointlessly SADISTIC behavior in public, what is kind of behavior can we expect from him when he thinks nobody is looking?
