60% majority is not in the Constitution as a requirement to pass legislation. The bill can be passed with two steps - both with a simple majority.

#1 Challenge the cloture rule, the challenge is placed on the floor and a new precedent is established with a simple majority.

#2 The bill can then be brought to the floor and passed with simple majorities.


It wouldn't take a single DEM vote. This path was shown by Reid with Federal Judges, and McConnell with SCOTUS Justices.


(Who do I blame? Politicians. The fact remains thought that a bill can be passed without a single DEM vote.)
