Paycheck Fairness Act

(CNSNews.com) – The Obama administration is backing legislation that includes regulations requiring U.S. businesses to provide to the government data about employee pay as it relates to the sex, race and national origin of employees.

In an orchestrated effort that included a statement by President Barack Obama and an event at the White House featuring Vice President Joe Biden, Attorney General Eric Holder and Labor Secretary Hilda Solis, the president and his cabinet endorsed the Paycheck Fairness Act.

“The Paycheck Fairness Act, which purports to prevent instances of illegal gender-based discrimination, could outlaw many legitimate practices employers use to set employee pay rates, even where there is no evidence of intentional discrimination and employers act with reasonable belief that their pay policies are lawful,” the statement said.

“Manufacturers strongly oppose unlawful discrimination in any form, but the Paycheck Fairness Act would impose unparalleled government control over how employees are paid, among even the nation’s smallest businesses,” it added.

“It would drastically alter the Equal Pay Act to allow unprecedented penalties of unlimited punitive and compensatory damages in cases of alleged discrimination,” the statement said.

James Sherk, Bradley Fellow in Labor Policy in the Center for Data Analysis at conservative The Heritage Foundation, said that the law would be a boon to trial lawyers seeking damages from employers for their clients and would allow the courts to “micro-manage” American businesses.

The government does not collect data on a person's sex in the tax returns so I don't think they could correlate wages with sex without this information.
There's no need to collect that information at all until a complaint is filed.
I would think it would be helpful to have the information in deciding whether to investigate a complaint or not. It would also spotlight industries and companies that have sexual discrimination problems.

Collecting this data should not be a problem for the employers since they have the data in their files.
Then you'll have no problem with fingerprinting everyone in the nation. Photographs, too. After all, it'll make solving crimes easier.

That's a half measure. Let's just collect DNA samples and facial and eye scans and be done with it. Oh, and we might as well do full colonoscopies so that the government has a roadmap around everyone's polops for crawling up our asses.

I recently had a situation where a black co worker believed he was being paid less because of Race.

The basic situation was this. We both work for the same construction labor service. Kinda like a temporary service but for construction workers.

Anyways we both got sent on the same job, but I was paid 3 Dollars an hour more than him. Well for 4 weeks I listened to him bitch about it. Finally I talked to him, and explained that the service paid based on experience for the job you are assigned to. I was paid 3 dollars more because I had 2 years of experience in the specific work we were doing. (Concrete finishing) while he was paid less because while he had construction experience in other fields he admittedly had never worked with Concrete before. And it showed. While on the job while I was usually finishing concrete, he was performing the duties of a laborer which are paid less than finishers. He was not being paid less because of his skin color he was being paid less based on his experience. After 3 days of talking about it he finally conceded I was probably right, but then added as a black you just never know, and are always suspicious. While I understand that is true, it often leads to incorrect feelings of being discriminated against. Like the one I just described.
