OKLAHOMA CITY, June 30 (Reuters) - The Oklahoma Supreme Court ruled on Tuesday that a Ten Commandments monument placed on State Capitol grounds must be removed because the Oklahoma Constitution bans the use of state property for the benefit of a religion.

The 6-foot-tall (1.8-meter) stone monument, paid for with private money and supported by lawmakers in the socially conservative state, was installed in 2012, prompting complaints that it violated the U.S. Constitution's provisions against government establishment of religion, as well as local laws.

In a 7-2 decision, the court said the placement of the monument violated a section in the state's constitution, which says no public money or property can be used either directly or indirectly for the "benefit, or support of any sect, church, denomination, or system of religion."

Lawmakers have argued that the monument was not serving a religious purpose but was meant to mark a historical event.

This opened the door for other groups, including Satanists and the Church of the Flying Spaghetti Monster, to apply for permission to erect their own monuments on Capitol grounds to mark what they say are historical events.

I'm pretty liberal on things, and I completely disagree with this decision, and here is the reason. Our most basic and important laws were derived from the ten commandments. No matter what anyone says, these laws are historical in context more than anything else. They do not promote Christianity. They are just the ten commandments from which so many of our laws were derived. Other groups claiming that other things are historical events cannot compare one iota to the scope of importance of the ten commandments to modern day laws. To me, this was a bad decision.

OKLAHOMA CITY, June 30 (Reuters) - The Oklahoma Supreme Court ruled on Tuesday that a Ten Commandments monument placed on State Capitol grounds must be removed because the Oklahoma Constitution bans the use of state property for the benefit of a religion.

The 6-foot-tall (1.8-meter) stone monument, paid for with private money and supported by lawmakers in the socially conservative state, was installed in 2012, prompting complaints that it violated the U.S. Constitution's provisions against government establishment of religion, as well as local laws.

In a 7-2 decision, the court said the placement of the monument violated a section in the state's constitution, which says no public money or property can be used either directly or indirectly for the "benefit, or support of any sect, church, denomination, or system of religion."

Lawmakers have argued that the monument was not serving a religious purpose but was meant to mark a historical event.

This opened the door for other groups, including Satanists and the Church of the Flying Spaghetti Monster, to apply for permission to erect their own monuments on Capitol grounds to mark what they say are historical events.

I applaud the Oklahoma Supreme Court for this decision.

I'm pretty liberal on things, and I completely disagree with this decision, and here is the reason. Our most basic and important laws were derived from the ten commandments. No matter what anyone says, these laws are historical in context more than anything else. They do not promote Christianity. They are just the ten commandments from which so many of our laws were derived. Other groups claiming that other things are historical events cannot compare one iota to the scope of importance of the ten commandments to modern day laws. To me, this was a bad decision.

To me it is an inconsequential decision

On what grounds would an appeal be made to the Supreme Court, the issue concerns the state constitution and the state Supreme Court's interpretation of a provision of that constitution – there's no substantial Federal question to be resolved because there's no First Amendment violation claim being made.

The Supreme Court, of course, can contrive any reason it wants to justify hearing a case, but this generally doesn't fall under the jurisdiction of the Supreme Court.

Van Orden concerned a claim that the monument violated the Establishment Clause of the Federal Constitution, which is not the case here.
