As for the whole victim's families v. Arlington FD; two distinctions can be drawn.

The victim's families are totally without fault in this matter; they are blameless that they are associated with 9/11. The FD members signed up for and knew in advance that they may have to respond to such an incident. Notifying the former is crass and would be something you'd do. Notifying the latter would be totally acceptable if not any less crass.
