The general jurisprudence on the subject holds that with a very few, very narrow exceptions, the First Amendment protects the right to photograph anything or anyone that is in public view, in a public place. One of these exceptions is “a reasonable expectation of privacy”. Traditionally, this has been understood to include places like locker rooms, which, even if government-owned (and thus, public property) are intended to allow people of one sex to undress, with the expectation of privacy from the view of the opposite sex.

It seems to me that if the ruling is allowed to stand, that girls undressing and showering in a girls' locker room do not have any right to “visual bodily privacy”, then this opens the door for a legal “right”, based on extant jurisprudence, to take photographs inside of girls' locker rooms.

Dozens of families sued the Chicago-area Township High School District 211 three years ago due to its policy letting students as young as 14 choose to use the locker rooms of the opposite sex.

“All the students must use the restroom with the knowledge that someone of the opposite sex is present or could walk in at any time,” their lawyers at the Alliance Defending Freedom wrote in a background document on the case.

It makes the stakes clear: “If our government is powerful enough to command innocent school children to disrobe in the presence of opposite-sex classmates, then there will be little it will not be powerful enough to do.”

The plaintiffs, organized as Students and Parents for Privacy, are composed of 52 families made up of 136 parents and current and future students who are “being forced to use the restroom, or change clothes, with someone of the opposite sex in the room.”

U.S. District Judge Jorge Alonso is letting Title IX and religious freedom claims go forward while throwing out other claims.

Who said our society has to be turned upside-down and inside out? I'm not sure what your point is. The bottom line is, girls shouldn't be forced to shower next to males, no matter what he wants to be in his head. And female athletes shouldn't have to compete with biological males, regardless of what they "identify" as.

Even less than 10 years ago this insanity was just that - insanity, a mental disorder. But now, because of intentional social engineering and brainwashing, everyone is supposed to go along with it? Sorry, but the emperor is wearing no clothes.

That is my point. We as a society should not have to turn everything on its head, so that one tenth of one percent of our male population, who are confused about their gender, can shower with our wives and daughters.
