Hit-and-run illegal alien at the wheel mowed down a man in a wheel chair in the crosswalk going 60 mph in an SUV!

Waltham, Massachusetts -- IMO, Bianca Contreras, 39 is an illegal alien and has been in the United States illegally for 10 years. She is accused of a Hit-and-run of a man in a wheel chair. She has pleaded not guilty.

The charges are driving without a Massachusetts driver's license, driving to endanger, leaving the scene with personal injury, using a motor vehicle without authority, speeding, failure to stop at a stop sign, and failure to stop for a pedestrian at a crosswalk.

Contreras maliciously ran over Scott "Scotty" Coxal, 39 a disabled man going 60 mph at twice the speed limit. Then she sped off and hid her SUV in a garage at the home where she was living.

Her bail was set for $50,000.00 and her cousin paid with cash and then she was released back out on the streets. Just a few hours later Immigration Control and Enforcement, (ICE) picked her up and put an immigration hold on her. Miss Contreras is currently being held by ICE in South Bay House of Correction in Boston.

Contreras has a 3-year-old-boy, who was born in America. So she used a sob story and volunteered to self deport herself instead of standing trial. A Boston Federal immigration judge ruled on 4/26/11 that Contreras should be deported. So, they planned on releasing her and deporting her to her country of origin which is Guatemala. She won't have to stand trial for motor vehicle homicide. The public and the victim’s family were outraged.

“The district attorney and the Department of Homeland Security are appealing the decision, but unless a criminal court is willing on Monday to hold Contreras without bond, the federal government’s hands are tied.”

Scotty’s father called it "Outrageous" and said, “I want [the judge] to explain to me how he can let someone that’s facing criminal charges just go home," Thomas Coxal told the Boston Herald. "I’d like to see her stand trial.”

THE VICTIM:

Scott "Scotty" Coxal, 39 was in the crosswalk crossing at Church and School streets in downtown Waltham. Contreras was traveling 60 miles per hour in a 30 mph speed zone. She then smashed into Scotty’s wheel chair with violent force with her big blue SUV. He was ejected out of his wheel chair in front of her upon impact. She quickly fled the scene and hid her vehicle in a garage alongside a Harley. The police found her later in her home all cozy and they took her into the Police station for questioning and then they arrested her.

Eye witnesses at the scene were stunned as Contreras fled the gruesome scene. She left Scotty’s unconscious body in the middle of the road in a bloody, mangled heap. His backpack and jacket were laying in the intersection of Main and School streets and his wheel chair was an unrecognizable pile of rubble. I'm sure that his wheel chair wasn't the only thing that was unrecognizable. How could someone do something like that to another human being???

A helicopter was called but it was too windy to fly. So an ambulance was called and when it arrived they drove him to the Newton-Wellesley Hospital. He was in serious condition when he was then transported to the Massachusetts General Hospital.

He suffered injuries to his head, upper right leg and internal organs, and had a broken femur in his right leg according to the police. It was 6:00 PM the day before Thanksgiving in 2011 when he was hit by Contreras. Scotty Coxal died 8 days later of his injuries, on the night of Thursday, December 1, 2011. Now, murder will be added to her charges.

Bianca Contreras will not return to Guatemala.

In an effort to reverse the deportation order the case went to the Board of Immigration Appeals to the Honorable Waltham District Court Judge Gregory Flynn. He ruled to revoke her bail.

The judge “also refused to relinquish the $50,000 back to Contreras’ cousin, pending the outcome of a civil suit filed by the victim’s parents.” Contreras is currently being held with NO bail and she can’t leave the United States. She’s now in state custody of the Commonwealth of Massachusetts.

ICE has a detainer on her and when she’s through facing criminal charges and has served her sentence. She’ll be turned over to ICE’s Enforcement and Removal Operations (ERO) office in Burlington, Mass., and then she will be deported back to her beloved Guatemala.
