It's not a war yet, but yes. If there are rules - those rules can be applied to anybody. If the USA can say that Iraq has WMD-program and invade it without UN permission, then Russia can say that Ukraine has WMD program and invade it, too.

According Russians doctrine it's still a "military conflict" and "military operation". They still don't use nukes and even rarely send conscrits in the battles. Talking about the level of involvement of the military forces (and the level of casualties) it's hardly more than during the military phase of second Chechen campaign.

Technically, Vietnam, Iraq and Korea were also not wars. Congress never declared war.

However, you didn't get put in jail for saying they are wars in the US. In Russia, you can be put in jail for that.

As a figure of speech they, of course, use that term (as well as 'Chechen war' or 'Syrian war') . But, it is important to understand (for all parties concerned) that de jure it's not a war, as well as flirting or harassment is not sex or raping.
