My great grandmother drank scotch daily. And not a small amount. She lived to 98.

She was a blast. Even fell down the stairs at 85 at a Christmas party and we made a Christmas song out of it.

Were not all born the same. When your body is done its done. End of story.

He could have had a drink before he went to bed, with him being over weight, his body probably didn't burn off alcohol that quickly.

That kind of BAC would take several drinks for man his size, and after bed, walking up, and walking, he'd have burned off some.

He was under 150 lbs? I do not know his weight be he seemed hefty; there was also time for the alcohol to wear off if he had been to bed, got up, got dressed and went walking. He had a history of heavy alcohol use, had quit illegal drugs years before. Being over weight LOWERS BAC levels.

Yes, but could still be charged with DUI. .08 is the threshold for a illegal with no other evidence, tough to overcome:
