If it's legal in the state they are in, then there is no crime and this no reason to take their guns away.
MJ is illegal under federal law.

Perhaps; this does not change the fact that MJ is illegal under federal law, and the federal government for not violate the 10th amendment by making it so.

IMO just having a card isn't enough there must be an actual federal drug conviction or a state conviction of being under the influence while in possession of a firearm for second amendment rights to be nullified.
That's not what the law says,, and that's not the question asked on the 4473.

Again, just as being of legal drinking age is not "proof" of intoxication. That's absurd.

If I have five bucks in my pocket and a McBurger costs five bucks, is that "proof" that I'm fat?
