Some are thinking they will, as well as other rulings.

"The Supreme Court will issue its final rulings today including a decision on the Biden Administrations efforts to end the Remain in Mexico Policy. The program began under the Trump Administration, it forces asylum seekers to stay in Mexico pending an immigration court’s decision."

It is scheduled for release today. It must be done before Justice Briare retires at Noon.
 
From the actions being taken by this administration they are expecting to lose this decision due to court precedent on proper procedure and process.

IF they do not strike this down it will mean free reign on all policies, and they can be changed by EO without process.

well yah, but that's sort of the point. Any potus is supposed to be able to order agencies to do a policy consistent with immigration law.

The current SC lineup favors overturning executive actions by democrats to force congress to act even though congress refuses to enact immigration reform.
 
And now its going to be a free for all in all agencies... Any agency policy can now be changed by EO...
remain in Mexico is abandoned.
But Trump changed administrative policy to create the stay in place policy. The law simply says amnesty seekers may be admitted or not. It takes 60 senators to make a law, and for some reason compromise seems impossible so long as we don't deport all the people here illegally, and btw there are as many now as when Trump was elected.

btw, stay in place was one, and maybe the only one, thing LOL I agreed with Trump's immigration policy. He also pretty well ended LEGAL immigration from Mexico and latin america.
