There is no difference between NDA and legal fees as far as the tax deduction is concerned.

Check the IRS, NDAs are not always tax deductable. NDA's for sexual harrassment or abuse are not tax deductable. Not saying this was part of this NDA.

Here it's not quite so easy as it seems and and actually works against Trump.

See if Trump had paid the legal fees out of his own accounts as a private individual, such legal fees are not considered a tax deductable business expense. Legal fees for personal actions are not tax deductable.

However legal fees for a business ARE tax deductable for non-sexual harrassement/abuse settlements. For example to protect trade secrets.

But in this case the taxable nature of the legal fees goes to show the Trump scheme was intended to hide Cohen's crime. To wit:
  • Cohen paid Daniels $130,000 to support Trump's campaign out of his own pocket. That would have been a reimbursable legal expense (expense not fee) that WOULD NOT have counted as income for Cohen (since it was a reimbursement) for money paid. Billed as a one time payment for a $130,000 expense.
  • However the Trump scheme was to reimburse Cohen for the expense (non-taxable) testimony at trial was specifically the $130,000 would be taxed up and invoiced for a retrainer that didn't exist for "services" that were not performed. All to hid Cohen's crime.
  • Finally by running it through his business to further hide the transactions his PERSONAL legal expenses are not a tax deduction for the BUSINESS enity.
So by running it though his business his attempted to make his personnal expense and tax deductable business expense.

From Cohen's perspective, reimbusement for the $130,000 would not be income, it would be reimbursement of an expense. But to hide it the Trump scheme was to "tax up" the amount to the Trump Organization could hide the reimbursement and pay it as income instead of reimbursement for boinking a porn star. While claiming it as a tax deduction when such personnal agreementgs are not tax deductable.

In other words it was a fake “felony”. His accountant paid his lawyer legal fees. No actual crime. The prosecution even said it wasn’t a crime itself, but only is because it was to cover up some other crime. Only they never specific this other “crime”, didn’t charge him with this other crime, and the judge instructed the jury they could make up any crime they like. So he was literally convicted over an imaginary crime that was never even charged much less proven in a court of law.

Call it whatever you want, it doesn’t change the fact that at this time, Trump is indeed a convicted felon. It didn’t stop me or you from voting for him. But he is still a convicted felon.

Under the 12th Amendment (ratified 1804), the House chose from the top three candidates (Jackson, Adams, Crawford). Each state delegation got one vote, needing a majority of states (13 of 24 at the time) to win

I’ve linked a copy of the sentence for you to read. I don’t expect you to read it. Not everyone who gets convicted of a felony serves time. It isn’t required as part of the sentence.

It was obtained after lying to a bank about his debt and the purpose of the loan. For that crime, he was indicted and convicted and incarcerated. So yes, illegally obtained.
Trump didn't use a loan for that puny amount. It was his money, pea brain.
