Falsification of business records to hide/aid in another crime (Cohen's federal felony campaign fraud) is not a misdemeanor, it's a felony.

The only think that kept him from getting a prison sentence was his election to President and the interference that would have had with his duties. So while no penalty was invoked, due to political considerations, the conviction stands.
