Why can't the government get a search warrant?

I was kind of wondering a very simply question about the apple iphone case with the government. Why can't the government get a search warrant to do so? Why are they unwilling to do that?

The problem with the entire Apple fiasco is that the FBI is demanding that Apple write code to unlock the encrypted phone. The problem with that is that the same code would unlock any Apple phone.

They did get a warrant. As ordered by a Court.

Plus, and this is big, they don't NEED a search warrant because the owner of the device gave them permission to search it.

Farook, the murdering goatlover, didn't own the phone, San Bernardino County, Farook the goatlovers employer, did.

And permission from the owner is all they need

The FBI has promised to allow Apple to keep the software secret and in their possession ONLY.

The FBI is NOT demanding that Apple create new software and give it to them. They're asking Apple to help them solve the murders of 14 Americans.

Apple is going to lose this standoff. As they should.

My belief is that there's a chance that the FBI have already cracked the phone. If they haven't, I doubt that they would have said a word about it.
Publicly admitting their "failure" does nothing but encourage a higher usage of that type of phone, while saying that they were able to crack it would possibly shift usage to some other form of communication that maybe the FBI couldn't access.

I doubt it. It's the goobermint. I doubt they could crack an egg.

In fact, the FBI and San Bernardino County are in a pissing contest right now about which one screwed the phone up.

I'm no expert on this so you might want to check on it yourself but I understand the phone was open until somebody at the County did something stupid and they're blaming the FBI for telling them to.

This phone is already unlocked, it took all of three seconds. why the lie, so that ISIS is presumably fooled into believing that their communications are secret when they are not. The government can listen to and record every phone call made and read every e-mail sent, it's just that simple.

I doubt it. It's the goobermint. I doubt they could crack an egg.
And it's in their best interest to keep everyone believing that. :eusa_shhh:
As a whole, you might be correct. I'd imagine, however, that they have a few sharp individuals that they can contract for this type of work.

I've heard the same thing mentioned in passing. Something to do with a password reset attempt, IIRC.

The FBI promised? lol Yeah, that gives me a warm fuzzy feeling.

Solve the murders? Is there some doubt as to who committed the crime?

It took Apple HUNDREDS of Engineers, thousands of hours, working in coordination to build the OS in those phones.

The government doesn't have that kind of brain-power in service. Never has. Never will.

Whenever the government needs real brains, they job it out. Whether it's NASA jobbing it out to Boeing or the Military jobbing it out to another Private source.

The coding on this OS to block a 'Brute Force' password cracker is elegant in its simplicity.

You get 4 (or 5?) chances to get your passcode right in the first couple minutes. Then you have to wait 5 minutes. Then you get another couple tries. Get those wrong and you gotta wait 15 minutes. Get those 2 (?) attempts wrong and you gotta wait an hour in between tries until after "X" number of tries, the phone wipes itself clean.

Simple.

Brute Force password crackers simply hit something with dozens of possible passcodes a second.... Or whatever they can stand.

In a four digit passcode, there are 10,000 possible codes.

With a Brute Force breaker, they could be in in a few minuntes.

But with Apple's simplistic stop, you can't.

The FBI needs the ability to re-write that blocker. And they don't have the ability. Believe it

The FBI believes, with substantial evidence, that there were others involved in the shootings.

They'd kinda like know who.

And so would I

And if Apple provides the FBI with a backdoor access program, the only thing stopping the gov't from using it elsewhere is their honor and integrity. If that doesn't scare you, you haven't been paying attention.

And so would I

Sure. We all would. But not at the expense of the guaranteed rights of the people. And that is the very real fear.

Encrypted Cell Phones have only been around for a few years and yet IDIOTS are screaming bloody murder that they are somehow a God Given Right?

What The Fuck, Over

And how do you have 'freedom' without security?

You don't. Without security, 'freedom' is meaningless. You want true freedom? Head over to the Hindu Kush in Asscrackistan.

Nobody there is going to try to crack your cell phone. They might crack something else, but certainly not your cell phone

You people are clueless. You demand absolute protection by the government and absolute freedom from snooping at the same time. No wonder our government is unresponsive to us. They think they're dealing with morons.

And they are.

Cook needs to work with the FBI on this.

How do we have freedom without security? I'm sorry, but freedom has never been dependent on security. In fact, there is no way a free society will ever be safe.

Encrypted cell phone have only been around a few years. But the 4th Amendment to the US Constitution has been around since 1791.

I don't know who this "you people" is that you are talking about. I have not demanded absolute protection. I have, however, demanded that the US Gov't abide by the US Constitution. But it seems to be an exercise in futility.

The murders of those 14th people were solved all along. We know exactly who killed those people. It's not a mystery.

Well, you impose the same conditions they do for the engravers of the dollar bills. Not anyone knows the the entire picture.

It would be easy to do in this case as well and have a senior group at Apple coordinate the work.

So now you know more about the crime than the FBI?

Your ignorance is surpassed only by your stupidity.

So you're down with pedophiles, stalkers, terrorists, spies (industrial and international), gang-bangers, murderers, kiddie-porn types and every other form of criminal scumbag having unfettered access to unbreakable, encrypted communications?

Figures. That's your kind of freedom, huh?

NAMBLA loves you.

You're real brave with other peoples' children and grandchildren. You don't care about your own, fine.

Some of us do

Some of us do

I am down with 'The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.".

I have no problem at all with a warrant being issued to search a suspect's electronics. But spare me the false nonsense about me wanting pedophiles and terrorists to have whatever. It is bullshit.
