Here are three things that people should understand about this situation...

1; inadvertently including the journalist in the discussion violates the "Gross Negligence" section of the Espionage Act. The espionage act does not require information that is shared to be classified. Any anyformation which deals with a legitimate national security concerns falls under the Espionage Act regardless of the classification the information holds. Radcliffe violated the gross negligence clause of Espionage Act when he included Goldberg in the chat without verifying him.

2; Goldberg, by his own admission believed that the chat was a hoax when he was first included in it. It wasn't until he read reports on twitter about the air strikes that matched the information being discussed in the chat that he realized the chat was real and immediately left it. Goldberg then sent emails to various officials who had been in the chat to reform them of his accidental inclusion.

3; no one who was involved in the chat after being emailed by goldberg reported the accidental leakage of defense information to Goldberg. This failure to report is also a violation of the Espionage Act. One that was committed by not only Radcliffe, but every single person who is in that chat.Who Goldberg made aware through email that the information was leaked to him. The espionage act requires any person who is made aware of an intelligence leak.Must report it and failure to do so is a crime.
