Washington DC is not a state. Unlike "state National Guards", which are typically under a governor’s control unless federalized, the "D.C. National Guard" is always under the authority of the President.
The President delegates this control to the Secretary of Defense, who can then delegate to other military officials (like the Secretary of the Army).
The Posse Comitatus Act of 1878.. Washington D.C. is not a state, which gives the President more direct control over its law enforcement and National Guard.
Home Rule Act (Section 740): Allows the President to take control of D.C.'s Metropolitan Police Department during emergencies. Donald Trump invoked this provision in 2025 to federalize the D.C. police and deploy D.C. National Guard troops, despite objections from local leaders. Specifically, it states that if the President determines "special conditions of an emergency nature exist," they can direct the Mayor to provide the MPD for federal use. This control lasts for 48 hours unless the President notifies Congress, in which case it can extend up to 30 days, unless further extended by a joint resolution of Congress.
Did Trump need Congressional approval?
No. As Commander-in-Chief, and due to the special federal status of D.C., the President does not need Congressional approval to deploy the D.C. National Guard. Washington DC is not a state.
