There's a difference between not enforcing the law and actively breaking it to send innocent people to a gulag.

You seem to think that every person that enters the U.S. illegally is required to spend time in a court. All they are entitled to is a determination of their status and reason for being in the U.S.
That can be but a two minute interview by an ICE or DHS employee. If it is determined that they have no legal right to be in the country then they may immediately be deported. That is the law. If during the interview it is determined that they maybe legally in the country but there is a question as to the legality of that claim they maybe detained. Again that is the law.
