He does not think the supreme court should be the policy writer of last resort, and is correct. Did you like it when the Supreme Court set policy and law in it's original position on Roe vs Wade?

Roe vs Wade is not policy making. It is about protecting the right of a woman to make decisions about her health. It is about the right to privacy. The Supreme Court decision in this case was policy making.

My point and theirs is, these things should be codified by the legislative process, if it is to be the law of the land, instead of the court, due to gutless legislators, on both sides. It is simply not what the Supreme Court was designed to do.
