This is common amongst death claims as I have seen this many times.
I had one years ago where an off duty Atlanta police officer was changing a tire for alady on I-20 at 11:30 pm. They claimed that since he had a few depression issues in his 18 year career he jumped out in front of the DUI driver that ran off the road and hit him.
