The two federal immigration agents who fired on Minneapolis protester Alex Pretti are identified in government records as Border Patrol agent Jesus Ochoa and Customs and Border Protection officer Raymundo Gutierrez.

The records viewed by ProPublica list Ochoa, 43, and Gutierrez, 35, as the shooters during the deadly encounter last weekend that left Pretti dead and ignited massive protests and calls for criminal investigations.

It looked really bad and it was an intentional homicide, but it will be charged as only 2nd Degree murder intentional: (The killer intended to cause death but did not plan it beforehand, e.g., a sudden argument turns deadly). Or it will be charged as 3rd Degree Murder (The "Depraved Mind" statute. This applies when someone commits an act "eminently dangerous to others" without regard for human life). But this is generally not charged in Minnesota, if the act was directed at a specific person. 10 rounds total with the first 3 in the back at point blank range is pretty specific.

There is the possibility of First-degree manslaughter (Heat of Passion)Killing someone intentionally but under "provocation" that would cause a reasonable person to lose self-control. This is unlikely as it does not count if the victim did not provoke the act, as in this case hands up, already disarmed and another cop shouts "Gun" and the two idiots panic and start blasting away.

There will be no Federal Charges, as they cleared these guys within 15 minutes, again. The Feds are good with whomever they kill, as this administration does not like Democrat Mayor or Governors, and figure their citizens deserve what they get, no matter what is done.

I agree it looks really bad. From where I'm sitting I cant see how they could do that, but to determine it was 1st degree murder you also have to consider factors that the agents were going through such as their own stress level in the situation. Its easy to look at a short clip and not see what was happening 20 minutes prior.

Take into consideration how many of the protestors are so certain these agents are akin to Nazis... by the same token, many of these agaents may go into the situation with pre conceived notions that they themselves are targets. Everything has an effect.

Add to that, what the heck are border agents doing in that situation anyways? aiding ICE all the way up in Minnesota? dealing with protestors who are interfering with operations. Its not really their job but the job of the city cops to be the buffer. Never should have been in that situation.

First degree murder requires 'malice aforethought.' That would suggest premeditation which is a ridiculous premise in a spontaneous event.

My understanding is the overtime pay and per diem are great, so that attracts agents that need the money and enjoy nice hotels, and maybe getting to shake up the locals, with the full backing of the government, no blowback or accountability. They are definitely not Nazis. The Nazis never wore masks to hide their identity.

I think the gun went off accidentally (the specific gun is know to do that), and officers that were already in a high stress situation had to assume he had another gun and reacted.

That's why you don't put yourself in these situations to begin with. Sadly, this guy was likely indoctrinated.. and was useful collateral damage for all the leftist NGO's and the DNC.. who are paying for all of these agitators to flood this area. Notice it's just one targeted area. This isn't organic. it's coordinated.

And the braintrusts? The ones that play the optics game? They're glad this guy is dead. You can take that to the bank.
