Because the plaintiff side has the burden of proof. The defense can attack all the elements of a case simultaneously for different reasons and under seemingly competing theories. They just have to convince a jury that 1 of the defenses on 1 of the elements is right.....at least in theory. If nothing else, they have to throw everything at the wall at trial in order to be able to raise the issues on appeal. If it isn't in the record, then the appeal court can't make a decision about it.
