I'm not agreeing this is really such a bad idea, aside from the fact that John Roberts does not need Trump's "help" in clarifying how law works. Surely he's busy enough ******* up trade and ending a war he said he'd end months ago.

But there is a tension between the constitutional prohibition on treating similarly situated persons differently (equal protection) and finding illegal discrimination solely upon unequal results. IF an employer has race neutral hiring policies that result in fewer blacks getting hired on % than whites, black plaintiffs want to prevail on a theory of race discrimination even if they cannot say what is the discrimination ... aside from fewer blacks getting hired.
