The Supreme Court on Thursday blocked the Biden administration's Covid-related eviction moratorium.
"Congress was on notice that a further extension would almost surely require new legislation, yet it failed to act in the several weeks leading up to the moratorium's expiration," the court wrote in an unsigned, eight-page opinion.
"If a federally imposed eviction moratorium is to continue, Congress must specifically authorize it," the court said.

Earlier this month, the CDC issued an order halting residential evictions for nonpayment of rent, “to prevent the further spread of COVID-19.” The order bars, in most cases, residential landlords throughout the United States from evicting tenants for nonpayment of rent until Dec. 31.

Although the order states that tenants remain obligated to comply with their leases and still may be charged for back rent, fines, fees, or interest, landlords effectively are left without real legal recourse for the duration of the CDC order. Landlords can’t replace tenants who don’t pay rent—or start legal proceedings against them—until next year.
