Trump claimed his threat to introduce a tariff on goods from Canada, Mexico and China was not a negotiating tactic but was necessary to boost the U.S. economy.

Contrast this with what Howard Lutnick said, that the tariffs are not a violation of USMCA because there is an emergency clause, and the emergency is Fentanyl production.

Isn't this a violation of USMCA?​

Just because Trump proposed USMCA and signed in into law, himself in July of 2020, does not mean he is above ripping it up with no notice. Agreements with the United States government are basically worthless, even if they are his.

Presidential emergency powers are nearly limitless, and any trade deal is ultimately only as good as all the signatories' willingness to abide by it. Congress does have the power to override national emergencies with a joint resolution, but getting a veto-proof majority in both chambers seems unlikely.

In September 2018, the United States, Mexico, and Canada reached an agreement to replace NAFTA with USMCA, and all three countries had ratified it by March 2020.
