As I pointed out in my thread on the subject, due process has ALWAYS been denied in certain cases, events or with certain groups of people. And even for US Citizens as in the case of Japanese Americans interred during WWII. You can play games with the wording of due process as written. But when the 5th and 14th amendments were written, there weren't too many Indians or Chinese laborers getting their due process rights.
 
When a person is arrested, detained, jailed, or deported, they are being deprive of their liberty and 5th amendments rights of due process apply.

These people have nothing to lose. They come from poverty stricken areas that are overrun by criminal gangs such as MS-13 and Barrio-18. Nearly everyone pays tributes or rents in one way or another. If they don't pay the gangs, they collect by taking their kids to become drug runners or sex slaves. So as I said, they have nothing to loose. They will keep coming back.

You apply from home, or you enter at a legal port of entry and request asylum.
You can apply but it's a waste of time. There is no waiting list The only way to enter the US legally is to have a family member in the US sponsor you or have a special skill and have a US company willing to sponsor you and pay a fee to the government each year for an H1 visa. Generally only scientist, engineers, or people at the top of their profession get selected.

In a documentary on Hatti I saw years ago, this Hattian said, "I want to come to the United States and I'm willing to wait in line as long as it takes but there is no line."
