A basis discussion of law has to go back to basic principles of a republic, and you do NOT want to try to use statutes as a basis for anything.
That is because statutes are often wrong.
Like we used to have statutes allowing slavery.
Does that mean slavery ever could really be legal?
Of course not, because slavery violates basic principles of a republic, which is based on the defense of inherent individual rights.
You can't legally have slavery in a republic.
The fact we did, just proves the legislators were deliberately wrong.
So now that we admit slavery is wrong, is everything fixed?
Nope.
When you go back to basic principles, then it is obvious that legal authority only comes from defense of rights of others.
And that means law that do not defend other, like drug laws, and adult sex laws, are all inherently illegal.
So we still have a long way to go.
Then we can come back to immigration.
And if we really believe in a republic, then we have to believe in that rights are inherent to ALL people, regardless of where they are born.
Maybe we can decide who gets to come here, but we certainly cannot deny them their day in court, since that is a universal right.
