Crossing the Border became a misdemeanor crime late in GW Bush's term when immigration reform passed.

Prior to 2008 or so, crossing the border was not a crime, it was A Civil Offense....like a parking ticket, or playing the music too loud in your apt building kind of thing.

In this reform bill, it was made a simple misdemeanor to cross illegally, and if in their immigration hearing they are denied entry as an asylum seeker and are deported back to their home country....if they are caught trying to enter again after deportation, it is a Felony.
