His rights were violated the moment the order was violated. He was deported to El Salvador despite the order saying he shouldn't have been. What was "due process" was violated.

Did you notice the date on the police report? Who was president then? Why did the Trump administration let him go? Why did they protect him? Obviously, you do not know how immigration court works, he was not found "guilty" of gang activity, it was found he could not prove he was not in a gang.

One of the officers involved in this stop was later criminally charged and successfully prosecuted for inappropriate actions as an officer. This is not about Garcia, MS-13, drugs, or violence. This is nothing more than attempt by the Trump administration to avoid "due process". Today, it is Garcia, tomorrow, it is you or I.

It has always been within the scope of authority of the Executive to deport invaders and those who entered the US illegally.

Not following the Court order that Garcia be protected from being sent back to ElSalvador.

And not trying to correct their admitted law breaking (mistake) by getting him back to the USA for his due court hearing, to get the court to remove the protection order....

No mention of him holding cash, drugs or that the other guys were MS-13. Then the MSM copies that story over and over and it becomes Democrat talking points. Sadly, that is how it works today. A federal I-213 form, (Record of Deportable/Inadmissible Alien), and a GFIS, Gang Field Interview Sheet, submitted about four hours after the encounter with Garcia. Neither piece of evidence has been made public.


The Court first reasoned that the Respondent failed to meet his burden of demonstrating that his release from custody would not pose a danger to others, as the evidence shows that he is a verified member ofMS-13. Matter ofSiniauskas, 27 l&N Dec. at 210; Matter of Adeniji, 22 l&N Dec. at 1111-13; 8 C.F.R. § 1003.19(h)(3). The BIA has held that, absent any indication that the information therein is incorrect or was the result of coercion or duress, Form 1-213 is "inherently trustworthy and admissible." Matter of Barcenas, 19 l&N Dec. 609,611 (BIA 1988). The Respondent contends that the Form 1-213 in his case erroneously states that he was detained in connection to a murder investigation. He also claims that the 1-213 is internally contradicts itself as to whether the Respondent fears returning to El Salvador. The reason for the Respondent's arrest given on his Form 1-213 does appear at odds with the Gang Field Interview Sheet, which states that the Respondent was approached because he and others were loitering outside of a Home Depot. Regardless, the determination that the Respondent is a 2 Case 8:25-cv-00951-PX Document 11-1 Filed 03/31/25 Page 3 of 3 gang member appears to be trustworthy and is supported by other evidence in the record, namely, information contained in the Gang Field Interview Sheet. Although the Court is reluctant to give evidentiary weight to the Respondent's clothing as an indication of gang affiliation, the fact that a "past, proven, and reliable source of information" verified the Respondent's gang membership, rank, and gang name is sufficient to support that the Respondent is a gang member, and the Respondent has failed to present evidence to rebut that assertion.

Nothing in there about drugs, or rolls of cash. And the judge had doubts about the clothing argument but considered the fact that a past proven and reliable source of information verified Garcia as a gang member. There was no opportunity to cross examine this CI, nor was there the opportunity to cross examine a single member of the police force that made the arrest. One officer, the one handling the CI, was later suspended, then dismissed, and then convicted of criminal behavior himself.
 
On this thread issue....

Trump admin broke a Court Order....broke the law....the Admin says it was a mistake....

The admin needs to correct their mistake, and FOLLOW THE LAW....bring him home and before a court.

If Garcia is as bad as big government says in their smear campaign that we have all seen, they will have no problems with the court ruling in Trump's favor, and if the court does not remove the court protection order for Garcia to ElSalvador, then Trump can arrange to deport him to another country.

Again, Trump needs to follow the law...

Garcia did NOT have “rolls of cash on him “. Supposedly the sweatshirt he wore had that symbolism.
